USE OF THE PRODUCTS PROVIDED WITH THIS AGREEMENT CONSTITUTES YOUR ACCEPTANCE OF THESE TERMS. IF YOU DO NOT AGREE TO THE TERMS OF THIS AGREEMENT, DO NOT COPY OR USE OUR PRODUCTS.

DEFINITIONS

This tVt End User License Agreement ("EULA") is a legal agreement between you the end user (whether an individual or a recognized legal entity) (the "licensee") and tVt for the products accompanied by this EULA, which includes digital music, video and associated media.

LICENSE GRANT

tVt grants you a license to use the media provided to you based on the terms of the license of the respective media file or digital contents of our products. For example, if the movie has been released under the terms of a Creative Commons BY-SA license, you are allowed to share and remix the movie as long as you name www.valkaama.com as the source of your creation and under the condition that you apply the same license to your work. Please refer to creativecommons.org for the detailed license text of Creative Commons licenses.

"You" means the company, entity or individual who is using this product. "Use" means all usages permitted by the respective license in use.

OWNERSHIP

tVt contributes most of its productions to the Commons and strongly supports the Free Culture spirit. This is why we use a wide range of available Creative Commons licenses. Some productions, i.e. media files or products, however are protected by all regulations of copyright laws.

LIABILITY

You agree that you will hold tVt harmless against any claims or liabilities arising out of the use of any tVt product including claims brought against you for the use of it.

WARRANTY

tVt warrants the product to be free from defects in material and workmanship for 30 days from delivery. Your sole and exclusive remedy for a breach of this warranty is the replacement of the product. Refunds will be given at the discretion of tVt. tVt and any related documentation is provided "as is" without warranty of any kind, either expressed or implied, including, without limitation, the implied warranties or merchantability, fitness for a particular purpose, or non-infringement. The entire risk arising out of use of tVt products remains with the LICENSEE.

GOVERNING LAW

This agreement shall in all respects be governed by and construed in accordance with the laws in force in Germany.

ENFORCEABILITY

If any part of this agreement is found void and unenforceable, the parties agree that such invalidity shall not affect the validity of the remaining portions of this agreement.
